Kaspersky Exits U.S. Market Amid Government Ban

In a significant development for the cybersecurity industry, Russian cybersecurity giant Kaspersky is set to lay off dozens of staff and exit the U.S. market following a U.S. government order banning the sale of the company’s software. The ban, which was announced in June, cites security risks associated with Kaspersky’s operations in Russia.

The Impact of the Ban

Kaspersky has announced that it will begin to “gradually wind down” its U.S. operations starting July 20, when the ban officially takes effect. According to Kaspersky, the U.S. business environment has become “no longer viable” due to the regulatory constraints imposed by the ban. Independent journalist Kim Zetter reported that fewer than 50 employees in the U.S. will be affected by the layoffs. Kaspersky spokesperson Sawyer VanHorn, who was also part of the layoffs, confirmed the company’s statement and the impending job cuts to TechCrunch.

Kaspersky’s Response

Initially, Kaspersky planned to challenge the ban, asserting that it “does not engage in activities which threaten U.S. national security” and vowed to “pursue all legally available options to preserve its current operations and relationships.” However, with the impending ban, the company has decided to cease its U.S. operations.

The U.S. Government’s Justification

The U.S. Commerce Department cited increased security and privacy risks as the reason for the ban, emphasizing the potential for the Russian government to exploit Kaspersky’s software to collect and weaponize personal information of American citizens. “Russia has shown it has the capacity, and even more than that, the intent to exploit Russian companies like Kaspersky to collect and weaponize the personal information of Americans,” U.S. Commerce Secretary Gina Raimondo stated.

The Scope of the Ban

The ban will prohibit Kaspersky from selling its antivirus software directly to U.S. consumers or through U.S.-based resellers. After September 29, Kaspersky will also be barred from providing software or security updates to its U.S. customers, which will lead to degraded protection from the antivirus software. The staggered approach to the ban is designed to give U.S. consumers time to find alternative cybersecurity solutions.

Sanctions on Executives

In addition to the ban, the U.S. Treasury has sanctioned several senior Kaspersky executives, effectively preventing U.S. customers from transacting with the company or any future ventures run by these executives. However, Chief Executive Eugene Kaspersky has not been sanctioned.

Historical Context

This is not the first time the U.S. government has taken action against Kaspersky. In 2017, the Trump administration banned the use of Kaspersky software across the federal government after Russian hackers stole classified U.S. documents from an intelligence contractor’s home computer running Kaspersky software. The nature of antivirus products, which often have broad access to devices to identify malicious threats, heightens the concern over potential misuse.

Current Status

As of now, Kaspersky’s products are unavailable for purchase on its U.S. website. Visitors to the site are met with a message stating, “For legal compliance purposes, Kaspersky products cannot be purchased from your country.”
